Global Event Compliance Policy

  

Computer Entertainment Supplier's Association ("CESA") hereby adopts this Global Event Compliance Policy (this "Policy") in order to manage events organized by CESA itself ("CESA Events") in a fair and reasonable manner and to realize the vision of the development of the computer entertainment industry in Japan and around the world.
Members, Officers and employees of CESA, and all staff members involved in the management of CESA Events (including in the planning stages), such as co-organizers and participant companies ("Involved Member"), shall comply with this Policy relating to the activities of CESA, including the management of CESA Events.

1. Fundamental Principles

1.1. In regard to the activities of CESA, including the management of CESA Events, an Involved Member shall duly recognize the activities which contribute the realization of vision of the development of the computer entertainment industry in Japan and around the world, and in order to realize such development, shall not pursue only its own interests, but also perform its activities in consideration of reasonableness and fairness.

1.2. An Involved Member shall comply with all domestic/foreign laws applicable to itself and the guidelines published by CESA, and all regulations pertaining to CESA Events ("Applicable Laws").

1.3. An Involved Member shall always act in accordance with a code of ethics and shall not partake in activities which damage the honor, credit, or prestige of CESA and/or CESA Events and other activities which damage the vision of CESA Events.

1.4. At CESA Events, an Involved Member shall not perform any extraneous activities, such as those related to political and religious organizations.

2. Appropriateness of activities at CESA Events

2.1. Lawfulness of CESA Events and their materials

2.1.1. In regard to the management of CESA Events, and the production and utilization of movies, pictures, documents, and all other materials used or published at CESA Events ("Event Contents"), an Involved Member shall comply with the Applicable Laws.

2.1.2. In regard to the management of CESA Events and the production and utilization of Event Contents, an Involved Member shall review in advance (i) whether the Event Contents are similar to other materials, and (ii) whether any third party uses patent rights, copyrighted works, and/or other intellectual property which are similar to the Event Contents. In the event that any similarity is found during such review, an Involved Member shall make the necessary efforts in order to respect intellectual property rights and other rights of third parties, and to not infringe them, including (i) negotiations or arrangements with the owner or management organization of such rights, or (ii) obtaining a written license from the owner.

2.1.3. An Involved Member shall make efforts to prevent visitors at CESA Events from interfering with property rights and other rights of third parties, such as appropriately drawing the attention of visitors at CESA Events with respect to the recording of movies, and live-streaming, etc. of CESA Events and Event Contents.

2.2. Appropriateness of advertisements at CESA Events

2.2.1. In all advertising and promotional activities related to CESA Events and Event Contents, an Involved Member shall comply with the Applicable Laws and adopt a method to convey their value and contents adequately, and shall not use contents contrary to the facts or containing misleading expressions.

2.2.2. In all advertising and promotional activities related to CESA Events and Event Contents, an Involved Member shall not perform advertising and promotional activities which violate the Applicable Laws, and shall not advertise or promote anti-social activities, such as gambling, alcohol, tobacco, illegal drugs, adult content, consumer finance, or arms and weapons. Additionally, they must comply with self-regulations established within their respective industries.

3. Social responsibilities taken by CESA Events

3.1. Contribution to healthy development of children and youth

3.1.1 An Involved Member shall recognize the fact that computer entertainment industry, including the gaming industry, has an important role with respect to the healthy development of children and the youth, shall duly recognize the effect of computer entertainment industry, and shall make efforts to ensure that CESA Events and Event Contents contribute to such role.

3.1.2 An Involved Member shall make efforts to sustain and develop the integrity of CESA Events, and shall make efforts to work intensively on activities contributing to the healthy development of children and the youth, IT education, the development of future generations, and shall not discourage such activities.

3.2. Contribution to development of local and global societies and preservation of the environment

3.2.1 An Involved Member in CESA Events, as a member of the local and global society, shall make efforts to work intensively on activities which contribute to the stability and development of such local and global society and the sustainability of such societies, and shall not discourage such activities.

3.2.2 An Involved Member shall make efforts to reduce the environmental footprint of all parts of CESA Events.

3.3. Rejection of anti-social forces

In regarding to the management of CESA Events, an Involved Member shall thoroughly reject anti-social forces, and shall not provide any benefit (including cash) to anti-social forces, regardless of the reason.

4. Appropriate control and use of assets, profit and loss, and information etc. regarding CESA Events

4.1 Appropriate use and control in the management of CESA Events An Involved Member shall appropriately control management funds related to CESA Events and other assets pertaining to CESA Events, and use them in line with the proper rights and purposes.

4.2 Encouragement of transparency for the management of CESA Events

4.2.1 An Involved Member shall not record false or inaccurate income or expenses on financial statements pertaining to CESA Events.

4.2.2 An Involved Member shall appropriately retain income and expense records in the preceding paragraph, and ensure the accuracy and integrity of such records.

4.2.3 Involved Member shall take into consideration the nature of public interest of CESA Events, ensure the transparency of its management, and appropriately disclose necessary information to CESA and other stakeholders in a timely manner.

4.3. Appropriate control of personal information and confidential information pertaining to the management of CESA Events

4.3.1 An Involved Member shall comply with the Act on the Protection of Personal Information and other relevant regulations, including the General Data Protection Regulation of the EU, and appropriately control and manage all personal information obtained in relation to CESA Events.

4.3.2 An Involved Member shall comply with the Unfair Competition Prevention Act and other relevant regulations, and appropriately control and manage all confidential information created, obtained, and/or disclosed in relation to CESA Events.

4.3.3 An Involved Member shall develop, maintain, and continuously operate an information control system in order to control the personal information and confidential information stipulated in the preceding two paragraphs, and appropriately use information network systems, such as IT devices, software, email, and the Internet.

5. Encouragement of healthy environment in relation to management of CESA Events

5.1. Respect of human rights and prohibition of discrimination and harassment at CESA Events

5.1.1 An Involved Member shall not directly or indirectly perform the following activities;
(i) Activities which infringe personal rights, such as defamation of a specific person
(ii) Activities which result in discrimination based on race, color, creed, religion, nationality, age, sex, origin, disabilities, etc.
(iii) Activities which constitute sexual harassment (i.e., sexual words or actions which are said or done against another party's will, and if the other party refuse such actions, the other party suffers a disadvantage, or the performance of work is interfered by the unpleasant working environment)
(iv) Activities which constitute power harassment (words or actions that are based on a dominant relationship over another party and that might have a negative effect on the working environment by such words or actions that exceed what is necessary and reasonable in the course of work)
(v) Activities which constitute maternity harassment (words or actions related to the use of maternity leave or childcare leave, or pregnancy or childbirth, which might have a negative effect on the working environment)

5.1.2 An Involved Member shall pay the maximum attention which is reasonably required to prevent Event Contents from containing material that encourages or facilitates the activities in the preceding paragraph.

5.2 Encouragement of safe management environment of CESA Events

An Involved Member shall make efforts to encourage an environment where Involved Members and visitors to CESA Events can participate in CESA Events in a safe and sanitary environment.
